After messing with this for a while I finally found the answer to playing this properly on xp. seems like the problem isn't newer windows at all, it's actually an issue with newer graphics cards. geforce series 8 (or the equivalent of) like I and the other person who posted here already will lead to the same problem he described and make it not really worth playing.
but if you load it up on a system with a geforce 7 series (or equivalent) or older, it runs perfectly on xp. no cutscene crashing, no d3d crashing.
